Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using chatcrunch.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms form a legally binding agreement between you and Loopcrunch PLT ("chatcrunch.io", "we", "us"). If you use the Service on behalf of a company, you represent that you have authority to accept these Terms for that entity.

2. Description of Service & AI Disclaimers

chatcrunch.io provides tools for managing WhatsApp conversations, including AI-powered replies and document-enhanced answers (RAG).

AI & Machine Learning Disclaimer

The Service uses AI to generate or suggest responses. AI may produce inaccurate, offensive, or biased outputs ("Hallucinations"). You agree that:

• You are responsible for reviewing AI-generated responses before sending them to customers.
• chatcrunch.io is not liable for damages caused by AI output, including financial, reputational, or compliance-related harm.
• You will not use the Service to generate unlawful or harmful content.

3. WhatsApp & Meta Compliance

chatcrunch.io integrates with WhatsApp Business Cloud API provided by Meta. Your use of WhatsApp through the Service is subject to WhatsApp’s Terms and Commerce Policies.

• No Affiliation: chatcrunch.io is not affiliated with or endorsed by WhatsApp or Meta.
• Risk of Ban: Violating WhatsApp policies (e.g., sending spam) may result in WhatsApp restricting your number. chatcrunch.io is not responsible for such actions and cannot issue refunds due to account bans.
• WhatsApp Fees: You are responsible for conversation fees charged by WhatsApp/Meta unless explicitly included in your subscription plan.

4. Account & Security

• You must be at least 18 years old to use the Service.
• You are responsible for maintaining account confidentiality and securing your credentials.
• You are responsible for all activity under your account.
• You must notify us immediately of unauthorized access or security issues.

5. User Content & Data

You retain ownership of all data, messages, media, documents, and files you upload or transmit ("User Content").

You grant chatcrunch.io a limited license to process and store User Content solely to operate and improve the Service (e.g., building embeddings for AI retrieval).

6. Acceptable Use Policy

You agree NOT to use the Service to:

• Send unsolicited bulk messages or violate anti-spam laws.
• Upload malicious software, viruses, or exploit code.
• Harass, threaten, or harm individuals.
• Reverse engineer or copy parts of the Service.
• Resell or sub-license the Service without explicit written permission.

We may suspend or terminate accounts violating this policy without prior notice.

7. Subscriptions, Payments & Refunds

• Recurring Billing: Subscription fees recur monthly or annually. Payments are processed via Stripe.
• Cancellation: You may cancel anytime through your dashboard. Service continues until the end of the billing period.
• No Refunds: Payments are non-refundable except where required by law.
• Price Changes: We may adjust pricing with 30 days’ notice.

8. Service Availability

We aim for reliable uptime, but the Service may experience interruptions due to maintenance, outages, or third-party issues such as WhatsApp Cloud API disruptions.

chatcrunch.io is not liable for losses caused by downtime, delayed messages, API failures, or disruptions outside our control.

9. Limitation of Liability

READ THIS SECTION CAREFULLY.

To the fullest extent permitted by law, Loopcrunch PLT is not liable for indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or goodwill.

Our total liability for any claim is limited to the amount you paid us in the 12 months prior to the event giving rise to the claim.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

10. Indemnification

You agree to indemnify and hold harmless Loopcrunch PLT from claims, damages, liabilities, and legal fees arising from:

• Your misuse of the Service.
• Your violation of WhatsApp or Meta policies.
• Your breach of these Terms.
• Your communications with customers via WhatsApp.

11. Termination

We may suspend or terminate your account immediately if we believe you:

• Violate these Terms or acceptable use rules.
• Cause legal or operational risk to chatcrunch.io or other users.
• Fail to pay subscription fees.

You may terminate your account at any time by contacting support or using dashboard settings.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Malaysia. Disputes shall be resolved exclusively in the courts of Kuala Lumpur.

13. Modifications

We may update these Terms periodically. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance.
